Purpose
The purpose of these Terms of Use is to prescribe the rights, obligations, and responsibilities of the Company and the User in utilizing the information guidance and reservation reception services (hereinafter referred to as the "Service") provided through the Car2Europe™ website (hereinafter referred to as the "Homepage") operated by JCG (hereinafter referred to as the "Company").
-
Definitions
The definitions of terms used herein shall be as follows:
- "Homepage" shall mean a virtual place of business operated by the Company for the purpose of providing information on the tax-free vehicle leasing (Transit Temporaire) program of French automotive manufacturers and receiving reservation applications.
- "User" shall mean any individual who accesses the Homepage and utilizes the Services provided by the Company in accordance with these Terms of Use.
- "Head Office" shall mean the French local automotive manufacturers and their corporate group who supervise the tax-free vehicle leasing program and serve as the actual party to the final contract and the supplier of the vehicle.
-

- The core scope of work of the Company shall be strictly limited to the following items, and the Company shall assume liabilities solely in relation to the execution of such work:
- Guidance and announcements regarding general information on this program;
- Mediation for the conclusion of contracts between the User and the Head Office, including the transmission of contract details to the User and requests for required documents;
- Receipt of contract payments and billing/payment information;
- Transmission of documents, payments, etc., received from the User to the Head Office;

-
Special Provisions on the Formation of Contract and Withdrawal of Subscription
- The act of a User submitting a reservation through the Homepage constitutes an "application and screening" phase for utilizing the tax-free lease, and shall not be deemed as the formation of a final, legally binding contract in and of itself.
- The final contract shall be established at the time the User satisfies the qualification criteria prescribed by the Head Office, agrees to the separate "Terms of Transit Temporaire Contract" (Terms of TT Contract), and completes the formal signing process.
- As this Service entails custom vehicle production and assignment procedures managed by the Head Office, standard statutory regulations regarding the withdrawal of subscription due to a simple change of mind under electronic commerce laws (such as unconditional refund within 7 days) shall not apply. Matters concerning cancellation and refunds shall be governed entirely by the separate "Terms of TT Contract" and the applicable cancellation policies.
-

- The User shall not replicate, transmit, publish, distribute, broadcast, or otherwise utilize for commercial purposes, or permit any third party to utilize, any information obtained through the use of the Homepage whose intellectual property rights belong to the Company, without the prior written consent of the Company.
-
